Welcome to Foxhole Medals. By accessing and using our website and services, you agree to comply with and be bound by the following Terms of Service (TOS). These terms govern your access to our website, purchase of goods, and use of our services. Please read them carefully.

By purchasing from Foxhole Medals, you acknowledge that you have read, understood, and agree to these terms. If you do not agree, please refrain from using our website or services.

2. Definitions

• We/Us/Our: Refers to Foxhole Medals.
• You/Your/Customer: Refers to the individual or entity purchasing goods or services from Foxhole Medals.
• Goods: Refers to any item sold through our website, including replica medals, badges, and challenge coins.
• Services: Refers to any additional services provided, including custom medal mounting, engraving, manufacturing, and shipping.

3. Changes to the Terms of Service

We reserve the right to update or modify these Terms of Service at any time, and such changes will be effective immediately upon posting on our website. Your continued use of the website following any changes constitutes your agreement to the updated terms. We recommend reviewing these Terms each time you access our website.

4. Registration and User Accounts

To access certain services on our website, you may be required to register and create an account. You agree to provide accurate and complete information when registering and to update this information as necessary. You are responsible for maintaining the confidentiality of your account information, including your password. We reserve the right to terminate or suspend accounts if you breach these Terms.

5. Eligibility to Purchase

Our products and services are available to individuals over the age of 18. By proceeding with a purchase, you confirm that you meet this age requirement. We reserve the right to refuse service or terminate access to users who misrepresent their age.

6. Orders and Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse any order at our discretion. When placing an order, you must provide accurate and up-to-date information. Incorrect information may result in delays or the cancellation of your order.

Orders are processed once payment is received. Any quoted production times, including our standard 10-business-day production timeline, are estimates and may vary based on demand and complexity. Priority processing is available during peak periods, such as ANZAC Day, subject to a 50% surcharge on the total order value.

7. Custom Orders

Custom orders, including bespoke medal sets and challenge coins, will follow a three-phase process:

1. Artwork Creation: Artwork will begin once the initial deposit or design service fee is received.
2. Sample Production: Once artwork is approved, samples will be produced.
3. Mass Production: Following sample approval, mass production will begin, with the final invoice payable before delivery.

If a project is cancelled after quotation acceptance but before artwork approval, a design service and administration fee will be charged to cover costs incurred.

8. Pricing and Payment Terms

Prices for goods and services are listed in Australian Dollars (AUD) and include GST unless otherwise stated. Foxhole Medals reserves the right to change prices without notice; however, confirmed orders will not be affected.

Payment must be made in full before dispatch, except for custom orders where separate invoicing may apply as outlined in the custom order process.

For shipping within Australia, a fixed shipping fee will apply:

• $19.95 for low-value small items.
• $22.95 for all other customers.

9. Shipping and Delivery

Foxhole Medals uses Australia Post eParcel Express for shipping, which is registered, tracked, and requires a signature on delivery. Delivery times are estimates and may vary depending on your location. Foxhole Medals is not liable for any delays once your order is dispatched.

If the customer requires a product by a specific event date, it is their responsibility to check the expected shipping date listed on the order confirmation and notify Foxhole Medals of any concerns immediately. Foxhole Medals will prioritise orders according to event dates and locations during non-peak periods.

All risk of loss or damage to the goods passes to the customer upon dispatch. We do not accept liability for goods lost or damaged in transit, and any claim for compensation must be directed to the carrier.

10. Product Descriptions

We strive to ensure that product descriptions on our website are accurate; however, we do not warrant that product descriptions, images, or prices are free from error. In the event of an incorrect description or pricing, we reserve the right to correct the error or cancel the order. Images on our website are for illustrative purposes only and may not precisely reflect the actual product.

11. Cancellations and Refunds

Once an order has been placed and payment has been processed, you cannot cancel the order due to a change of mind. Custom orders and personalised products (e.g., custom-mounted medals) are non-refundable once production has commenced.

In cases where an error in pricing or product description has occurred, we reserve the right to cancel the transaction and provide a full refund.

12. Product Returns

We undertake to replace any product delivered to you that is faulty or damaged. If you wish to return a faulty or damaged product, you must notify us via our Help Center page and follow the return instructions.

You may return unused, undamaged products for an exchange within 7 days of receipt. We do not provide refunds for change-of-mind returns, and all return shipping costs are your responsibility.

Custom products that cannot be resold (such as unique medal sets or engraved items) are not eligible for returns or exchanges unless faulty.

13. Preparation of Non-Foxhole Medals

If customers send medals not originally mounted by Foxhole Medals for updates, a dismantling fee applies - the fees at time of preparation of these Terms is:

• $10 per full-size medal
• $7.50 per miniature medal

This fee covers the time required to dismantle, clean, and prepare non-Foxhole medals for remounting. There is no fee for medals previously mounted by Foxhole Medals, as professional-grade products are used that are easy to remove without damaging the medals.

14. Intellectual Property

All content on our website, including product designs, descriptions, images, and trademarks, are the intellectual property of Foxhole Medals. You are granted a limited license to access and use this content for personal, non-commercial purposes only. Any unauthorised use, including copying, reproducing, or distributing our content, is strictly prohibited.

15. Website Access and Use

You are permitted to access and use our website for personal use only. The use of any data mining, robots, or similar data extraction tools is prohibited. You may not reproduce, distribute, or display any part of this website without prior written consent from Foxhole Medals.

16. Hyperlinks

Our website may contain hyperlinks to third-party websites. These links are provided for convenience only, and we are not responsible for the content or practices of these third-party websites. Linking to our website without permission is prohibited.

18. Limitation of Liability

Foxhole Medals’ liability is limited to the value of the goods purchased. We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.

We do not accept liability for any loss or damage arising from the use of this website, including the presence of viruses or malware.

19. Dispute Resolution

In the event of a dispute, we encourage you to contact us directly to resolve the issue. If the matter cannot be resolved through mutual agreement, it will be referred to mediation in accordance with the laws of Tasmania, Australia.

20. Force Majeure

We are not liable for delays or failure to fulfil our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, or transportation disruptions. In such events, we may terminate or suspend services with notice.

21. Compliance with Australian Consumer Law

Foxhole Medals complies with the provisions of the Australian Consumer Law (ACL). Nothing in these Terms of Service excludes your statutory rights under the ACL, and any exclusions or limitations of liability shall only apply to the extent permitted by law.

22. Governing Law

These Terms of Service are governed by the laws of Tasmania, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Tasmania.
